It is stated that Pino was attempting to help a motorist when Highsmith caused the accident.
Pino and his counsel are arguing that Highwood should be held responsible because he was driving at 45 MPH, which is above the 40 MPH speed limit on the road where the accident took place.
The injured bystander is seeking unspecified damages but TMZ states the value to be more than $50 thousand. Pino's family also set up a GoFundMe to raise enough money to cover his medical expenses with a goal of $100 thousand.
Highsmith was not injured, and his manager, Jerry Dianis, stated that he helped out Pino right after the accident by consoling him and standing by his side until the ambulance arrived. Dianis had also stated that there were no lights on the road at night.
The accident caused Highsmith to miss the Heat's 116-104 victory over the San Antonio Spurs, but he received minutes in the games versus the Boston Celtics, Milwaukee Bucks, and Philadelphia 76ers.
