Partizan ordered to pay hefty sum to Wasserman agency after losing another BAT case / News - Basketnews.com

Belgrade Partizan lost the BAT case against Wasserman agency for unpaid agency fees and was ordered to pay 80 116 euros.

Partizan NIS Belgrade lost another BAT resulting in another hefty fine for the club.

BAT announced that Partizan will have to pay 80 116 euros to Wasserman agency for unpaid agency fees, including the legal fees.

BAT decision stands as follows:

1. Basketball Club Partizan is ordered to pay Wasserman Media Group the amount of EUR 60,000.00 net for unpaid agency fees, plus 5% interest per annum until payment

from 1 October 2019 on the amount of EUR 10,000.00; from 1 October 2020 on the amount of EUR 50,000.00.

2. Basketball Club Partizan shall pay to Wasserman Media Group EUR 7,500.00 as reimbursement for its arbitration costs (in addition to the amount of EUR 2,500.00 ordered in the Consent Partial Award).

3. Basketball Club Partizan is ordered to pay to Wasserman Media Group EUR 9,066.00 as a contribution towards its legal fees and expenses (in addition to the contribution of EUR 1,050.00 ordered in the Consent Partial Award).

4. Any other or further-reaching requests for relief are dismissed.

As it is noted in the case report, the initial subject of this arbitration was Wasserman's claims for agency fees relating to six contracts: players Aleksej Nikolic, Braian Angola, Amar Gegic, Rashaw Thomas, Uros Trifunovic, and head coach Andrea Trinchieri.

Wasserman's agreement with Partizan regarding agency fees for Trinchieri's contract is given in more detail.

According to the agreement, Partizan had to pay Wasserman in such a manner:

For the 2018-19 Basketball Season:

€32,000.00 until September 30, 2018

For the 2019-20 Basketball Season:

€50,000.00 until September 30, 2019

For the 2020-21 Basketball Season:

€50,000.00 until September 30, 2020

However, after the 2019-20 season was suspended in March, Trinchieri and Wasserman terminated the contract with Partizan because of unpaid salary to the Italian coach and other reasons, including unpaid agency fees.

Partizan argued that the club shouldn't pay the full sum for the 2019-20 season because the season itself and the contract were suspended prematurely. The Serbian powerhouse also made the case for not paying the agency fees for the 2020-21 season since Trinchieri signed with FC Bayern Munich.

However, BAT disagreed with such reasoning, arguing that Partizan should have paid the agency fee way earlier than the pandemic started.

As for the 2020-21 season, BAT also didn't support Partizan's claim, stating that the contract and agreement were fully guaranteed and were terminated due to Partizan's material breach of contract by not paying Trinchieri's salary and agency fees.

On June 9, BAT announced that Partizan will need to pay Trinchieri 115,400 euros, including the legal fees.
